Guest Booking Terms and Conditions

This document defines the general reservation and payment terms relating to bookings made with Lyngen Arctic Adventures AS (hereinafter referred to as "LAA") with Norwegian reg. no. 991 802 983, whose registered office is Lyngen Lodge, Djupvik, 9146 Olderdalen, Norway.

 

1 Introduction

1.1 The following sections outlines our terms and conditions (the "T&Cs"). These T&Cs govern al bookings made with LAA, either directly via LAA's own reservation services, such as lyngenlodge.com, or via third party reservations.

2 Bookings

2.1 By completing a booking and paying the applicable fee(s) in accordance with Section 3, you acknowledge and accept the T&Cs and confirm that you have read and understand the LAA Privacy Policy. You furthermore confirm that you are of legal age (18 years) and/or are authorized to enter into this binding contract with LAA.

2.2 Bookings are non-transferrable and non-refundable in accordance with the cancellation limitations defined in section 6 below. Name changes are only permitted upon LAA's express written confirmation.

3 Payment

3.1 Upon booking a stay with LAA, you are required to pay 25% of the accommodation cost. The booking is not binding or otherwise secured until such fee has been paid, and upon your receipt of a written booking confirmation.

3.2 For general bookings, the remaining 75 % booking fee is due upon checkout.

3.3 For the following seasons, the remaining 75 % accommodation cost shall be paid in accordance with the below deadlines. Any bookings made later than the below time limits shall be made in full. Payments are made online via lyngenlodge.com or by bank/wire transfer to 4750 20 10111 / NO1647502010111.

     (a) 4 weeks before the arrival date for Ski Season Guests (March – May).
     (b) 4 weeks before the arrival date for all Lodge Exclusive bookings (ALL SEASONS).
     (c) 3 weeks before the arrival date for Northern Light Season Guests (November – March).

3.4 Special payment terms: The following bookings shall be paid via bank wire transfer. If you wish to pay by credit card, an additional surcharge of 2.6% will apply.

     (a) All Lodge Exclusive bookings (rooms booked for exclusive use);
     (b) Any total booking fees in excess of NOK 70,000.

3.5 NETAXEPT processes all credit and debit card payments. This is a secure online payment solution for Visa and MasterCard. All card information is kept in accordance with the individual card companies' regulations.

3.6 You are solely responsible for any additional surcharges made by third parties, including your financial institution.

3.7 LAA reserves the right to adjust the prices (before and after a booking has been completed) as a result of changes in costs due to increased taxes and fees or other conditions outside of the LAA's control.

4 Accommodation 

4.1 LAA offers the following room types: Single, twin, and double. LAA will always seek to meet your requests on room type, but is unable to provide any guarantee. LAA shall in no event be held liable for failing to provide requested room type or other requests.

4.2 Maximum occupancy per room is two persons.

4.3 There is an 18-year age limit. LAA reserves the right to cancel the booking if no valid ID can be produced.

4.4 Child policy – the following age restrictions apply in the various seasons:

     (a) Summer Season (June – October): Minimum age 4;
     (b) Northern Light Season (November – March): Minimum age 12;
     (c) Ski Season (March – May): Minimum age 16.

4.5 During the Ski Season: LAA will provide twin/double accommodation with en suite facilities. Single rooms can be booked at additional cost. Subject to availability. 

4.6 LAA holds a public license for sale of alcohol. You are prohibited from consuming alcohol purchased from third parties (or off-premises) in public areas (including terrace, spa and hot tub). Exception is only made for guest bedrooms.

5 Cancellations

5.1 LAA reserves the right to cancel bookings for the following reasons:

     (a) Failure to meet sufficient number of bookings to financially stay open. The viability of such bookings is LAA's sole decision; 
     (b) Erroneous or mistyped rates, of which LAA instead may choose to correct the charge, subsequent to getting in touch with you via the contact information that you have provided;
     (c) Failure to meet any payment terms.

5.2 Cancellations made by LAA in accordance with above subsections (a) and (b), entitles you to full refund for any payments made to LAA in accordance with these T&Cs. No refund is made in connection with cancellations in accordance with subsection (c) above.

5.3 You may always cancel your booking(s) upon providing notification to LAA. No deposit payments will be refunded. You are also obligated to pay the whole booking fee, unless you provide cancellation notice in accordance with the following requirements:

     (a) Within 28 days prior to the first date of the booking during Ski Season (March – May);
     (b) Within 21 days prior to the first date of the booking during the Northern Light Season (November – March), or for bookings with a value exceeding NOK 35,000;
     (c) Within 14 days prior to the first date of the booking during the Summer Season (June – October).

5.4 Any conditions, warranties, representations and other terms, which might otherwise be implied by law, are excluded.

5.5 LAA shall not be liable for any direct or any indirect or consequential losses, including but not limited to, cost associated with flights, rental cars, other hotels, and similar, loss of profits, loss of sales, loss of business, business interruption, loss of business opportunity, goodwill and/or reputation or any other damages arising out of or in any way connected with your booking or stay with LAA.

6 Booking Activities 

6.1 LAA offers a variety of activities during the various seasons. The activities can be booked upon arrival at the lodge. Upon booking activities, you are obligated to pay for the activity in full unless cancelling such booking before 20.00 (8:00 PM) the night before the activity is to take place.

6.2 You must inform LAA of any special medical needs, allergies or dietary requirements at the time of booking activities. 

6.3 LAA will always strive to carry out trips as planned. However, certain activities are weather dependent. In case of bad weather, LAA will offer an alternative activity. The same applies in the event an activity is cancelled due to LAA's own fault. In such case, you are free to dismiss the alternative activity offering. LAA is not obligated to offer alternative activities in the event you are unable to attend due to illness or injury.

6.4 You understand and accept the risks involved with all of the activities of your trip. You understand and accept the risks involved with ski touring and skiing off-piste and you do so at your own risk and responsibility.

6.5 It is your own responsibility to ensure adequate insurance coverage for any of LAA's offered activities. Your insurance must cover you for all of the activities of your skiing trip as well as travel and personal insurance. You must ensure you have adequate cover for search, helicopter rescue and repatriation in the event of a medical emergency.

6.6 LAA is not liable or otherwise responsible for any damage, loss or cost associated with:

     (a) Weather or any other unforeseeable or unavoidable conditions;
     (b) Illness, injury or death sustained during a trip, activity or similar;
     (c) Loss of personal belongings.

6.7 LAA might take photographs and video of certain activities and trips. You agree to permit LAA to take photographs and videos of you (and any person you represent) for marketing purposes, without requesting any additional permission from you. LAA's use of such materials shall be free of charge. You agree to assign to LAA any rights you might have to such materials.

7 Late Payment and Liability in the Event of Damage

7.1 In case of outstanding/late payments, LAA retains the right to claim an 8.5 % annual interest rate, or the maximum applicable national statutory interest, whichever is greater.

7.2 If you, or whomever you represent, are responsible for any damage to LAA's property resulting from negligent or irresponsible behavior. LAA rooms are non-smoking. In case of infringement of this rule, LAA will claim a standard NOK 2,000 fee for extra cleaning of the room. This fee will be debited from the final invoice.

8 Miscellaneous

8.1 While every effort has been made to ensure the accuracy of all advertising materials and information, LAA cannot be held responsible for any inaccuracies.

8.2 Any complaints regarding LAA trips must be made immediately at the time of the stay. If you feel that your complaint has not been properly dealt with, you must notify LAA in writing within 30 days of the end date of your stay.

8.3 This Agreement shall in all respects be governed by and construed in accordance with the laws of Norway.

8.4 Any dispute arising out of or in connection with this Agreement shall be amicably negotiated between the Parties and, failing resolution, shall be referred to and finally resolved in Nord-Troms tingrett (district court).
